MARTINEZ — A Contra Costa jury convicted an Antioch man of first-degree murder Monday, in a case stemming from a November 2020 shooting that occurred after the defendant and the suspect engaged in fistfights.
Steven Wade, 34, was found guilty of murdering 40-year-old Antioch resident Curtis Gaines. His sentencing date has been set for June and he remains jailed in the meantime.
Gaines was fatally shot in Antioch on the afternoon Nov. 5, 2020. Authorities say he and Wade had a personal conflict and that on the afternoon in question, Wade challenged him to a fight near West 20th and A streets.
During the fistfight, Wade was knocked down twice. He then retrieved a gun from a nearby vehicle, came back, and shot Gaines, authorities say. The entire incident was captured by a surveillance video camera.
During trial, the defense argued that because of the fight, Wade lacked the ability to premeditate and deliberate and therefore couldn’t be convicted of first degree murder under the law.
