A chain bagel shop near the University of Denver has closed but will be replaced by a different chain bagel shop.
Einstein Bros. Bagels is poised to open at 2000 S. University Blvd., according to permitting documents submitted to Denver. It replaces Bruegger’s Bagels, which shuttered in recent weeks.
The two companies, both of which are based in Denver and owned by German conglomerate JAB Holding Co., did not respond to requests for comment.
Both companies sell bagels around the country. Einstein has 52 locations in Colorado, according to the company website, while the closure leaves Bruegger’s without a store in the state.
The store on University was owned by a franchisee, Shawn Carter. Last November, he sued the company over its efforts to close the store.
Bruegger’s claimed that the store was run-down and harmed the brand’s reputation and wanted Carter to renovate it. Carter said he was willing to renovate the store but wanted its franchise agreement renewed before doing so.
In December, a Denver district judge ordered that the store could stay open until a jury could weigh in on whether either side had breached their franchise agreement.
The case was settled in May before it could go to trial, court records indicate. The settlement details are not public.
Attempts to reach Carter were unsuccessful. His attorney did not respond to a request for comment.
