Sean ‘Diddy’ Combs’ Case Could End in a Mistrial, Which Would Be a Win for the Defense, Says Expert

Sean “Diddy” Combs’ case has gone to the jury, and one attorney thinks there’s a possibility that things could end in a mistrial. After weeks of testimony and arguments from the prosecution and defense, the jury will decide Combs’ fate. If the jury is unable to come to a unanimous decision, it will result in a mistrial. This could be a good thing for the defense.

Former federal prosecutor Mark Chutkow believes that the prosecution has done a solid job of presenting their case. They showed jurors video footage and called 34 witnesses. Chutkow told <a href=”https://www.forbes.com/sites/conormurray/2025/06/30/jury-begins-deliberating-criminal-case-against-diddy-heres-why-a-verdict-is-so-unpredictable/” target=”_blank” rel=”noreferrer noopener”>Forbes he thinks the prosecution made a “very compelling case.”

Ultimately, though, Chutkow said that the prosecution had to prove Combs was guilty of sex trafficking and racketeering. While the jury could see the video footage, particularly of Combs attacking Cassie Ventura in a hotel, as evidence of abuse, it does not prove sex trafficking or racketeering.

If the prosecution has not convinced every juror, the trial could end in a hung jury. In this case, the case could go to trial again. This would give the defense time to look for inconsistencies in witness testimony, which could be advantageous to Combs.

Combs’ lawyers have sought out a mistrial twice. The first time, they objected to a line of questioning related to the arson investigation into Kid Cudi’s car. They believed one question unfairly hinted that Combs had something to do with missing evidence.

The second time, Combs’ lawyer Alexandra Shapiro said prosecutors brought forward “demonstrably false” evidence related to the testimony of Ventura’s friend Bryana Bongolan. Bongolan testified that Combs held her off up to a Los Angeles apartment balcony. She said she documented injuries from Sept. 26, but Combs’ lawyers were able to prove he was in New York at this time.

“The government knew or should have known this testimony was perjured, and that Ms. Bongolan could not possibly have been injured by Mr. Combs on a Los Angeles balcony in the early morning hours of September 26, or even the day before that,” Shapiro wrote, per <a target=”_blank” href=”https://abcnews.go.com/US/lawyers-sean-diddy-combs-mistrial-sex-trafficking-case/story?id=122617769″ rel=”noreferrer noopener”>ABC News.

Judge Arun Subramanian denied both requests for a mistrial.

How much time could he face in prison if convicted?

Combs faces one count of racketeering conspiracy, two counts of sex trafficking by force, fraud, or coercion, and two counts of transportation to engage in prostitution. He denies the allegations against him and pleaded not guilty.

Combs’ sex trafficking charge carries a minimum sentence of 15 years, and transportation for the purpose of prostitution carries a maximum charge of 10 years. Racketeering and sex trafficking both carry maximum sentences of life in prison.
