While once potentially viewed as unromantic, they now serve as practical protection in an industry where fortunes can shift overnight. With <a href=”https://www.cheatsheet.com/news/jennifer-lopez-ben-affleck-sign-prenup.html/”>high-profile divorces</a> frequently splashed across headlines, stars are increasingly turning to prenups to preserve personal wealth, intellectual property, and brand value. Divorce and family law attorney Kirk Stange, founding attorney of <a href=”https://www.stangelawfirm.com/” target=”_blank” rel=”noreferrer noopener”>Stange Law Firm</a> and author of <em>Prenuptial Agreements Line by Line</em>, gave his top prenup tips. And he mentioned the most shocking celebrity couple without one.</p>

<p id=”par-2_73″>From musicians with multimillion-dollar catalogs to actors with production deals and influencers with booming beauty lines, modern celebrity prenups go beyond dividing assets. While some couples still opt out, their choices can spark public fascination (and in some cases, shock). This is especially true when unexpected splits turn into drawn-out legal battles. Divorce and family law attorney Kirk Stange explained to Showbiz Cheat Sheet how <a href=”https://www.cheatsheet.com/news/why-dont-justin-bieber-meghan-markle-and-these-other-celebs-have-prenups.html/”>celebrity prenups</a> differ from the average couple. </p>

<p id=”par-3_50″>“Typically, celebrities are going to have a lot more assets, a lot more money coming into the marriage that they get concerned about and want to ensure that, in the case of divorce, they’re going to be able to keep the assets they had coming into it,” Stange explained. </p>

<p id=”par-4_55″>Stange noted that spousal maintenance, or alimony, can be a “big issue” for stars. “There could be clauses that bar anybody from getting spousal maintenance or alimony in the instance of divorce, or there could be limitations on the amount that’d be awarded for the length of time,” he said. “That could be quite common.”</p>

<p id=”par-5_71″>Stange noted that the average couple typically doesn’t include “lifestyle clauses” in their prenups. “You hear lots of reports about celebrities having these lifestyle clauses in their prenuptial agreement, which could be all kinds of things, from not cheating on one another, to rules about social media, or drug and alcohol use,” he continued. “These clauses are typically taboo. Most courts frown upon them and don’t enforce these kinds of clauses.”</p>

<p id=”par-6_22″>Kirk Stange encourages couples considering marriage to get prenups. “It does take a lot of issues off the table,” he said. </p>

<p id=”par-7_45″>As for his top tips, Stange says each individual in the relationship needs to have their own attorney. “Both parties need to have an attorney for a prenup to be entered into,” he said. “They need somebody advising them about the pros and the cons.”</p>

<p id=”par-8_28″>“Both parties not having independent counsel can be a big basis for a court to set aside a prenuptial agreement,” Stange warned. “Both parties must have an attorney.”</p>

<p id=”par-9_61″>His next tip involves accuracy and honesty in financial disclosure. “You’ve got to list all your assets, all your debts; you’ve got to reveal your income,” he explained. “And typically, parties are advised to be thorough, and list everything, and be diligent, and provide supplemental documentation to verify. This is where a lot of parties don’t want to do this.” </p>

<p id=”par-10_18″>If finances are omitted or forgotten, “that can be a huge basis for setting aside a prenuptial agreement.”</p>

<p id=”par-11_65″>Finally, Stange says couples with a wedding date should hustle to complete their prenups. “The further away from the wedding day, the better,” he said. “Another basis for setting aside prenups would be duress, undue influence, [or] pressure has been put on somebody to do a prenuptial agreement. … The closer you are to a wedding date, the easier it is to make that argument.”</p>

<p id=”par-12_47″>Sources indicate that <a href=”https://www.cheatsheet.com/news/kanye-west-bianca-censori-prenup.html/”>Kanye “Ye” West and Bianca Censori</a>, who reputedly married in December 2022, <a href=”https://www.cheatsheet.com/news/bianca-censori-massive-payday-turns-kanye-west-attorney-says.html/”>did not sign a prenuptial agreement</a>. In California, without a prenup, the couple generally splits marital assets and debts 50/50. If Censori ever divorced West, she could receive a lot of money.</p>

<p id=”par-13_40″>“That was quite a shocker, with that kind of money and wealth, that he didn’t have a prenup,” Kirk Stange said of West. “That was all over the press and surprising, for sure, that he wouldn’t have a prenuptial agreement.”</p>
