Hayward man who severed man’s leg, killing him, in car crash to get 4 years

OAKLAND — A Hayward resident who reportedly crashed a stolen car, severing a 42-year-old man’s leg and killing him, has agreed to serve four years in state prison, court records show.

Jose Gonzalez will be formally sentenced on Oct. 14, the day after his 36th birthday, according to court records. He has been in jail since May 2024 and will receive credit for the time he has spent behind bars.

Gonzalez pleaded no contest to vehicular manslaughter on Sept. 15. His sentence can be reduced by half with good behavior, according to court records.

On Oct. 25, 2023, Gonzalez allegedly crashed a stolen SUV on the 4200 block of International Boulevard in Oakland, pinning Luciano Carmona-Garcia between that vehicle and a minivan, according to court records. Gonzalez escaped before police got there but left behind a Gatorade bottle with his DNA on it, police said in court records.

Carmona-Garcia’s leg was completely severed and he died from blood loss, authorities said.

The case went unsolved until February 2024, when police arrested a person on suspicion of driving a stolen car, who provided information implicating Gonzalez in the hit and run.
