The charge is said to relate to reports of an assault on a 45-year-old man in Frodsham, Cheshire, made to police at 2.48am on October 26.
It comes after CCTV footage emerged showing the The Runcorn and Helsby MP allegedly punching a constituent during a late night row.
Hours earlier, Amesbury had posed for snaps with the local police commissioner.
The MP said he was “listening to residents’ concerns and ideas for policing and community safety”.
Amesbury and the constituent are believed to have clashed over the temporary closure of a local bridge and winter fuel allowance cuts.
Rosemary Ainslie, Head of the Crown Prosecution Service’s Special Crime Division, said: “Following a review of the evidence provided by Cheshire Police, we have authorised a charge of common assault against Mike Amesbury MP, 55.
“The charge follows an alleged assault in Frodsham, Cheshire, on Saturday, 26 October 2024.
A spokesman for Cheshire Police added: “Mike Amesbury MP, of Frodsham, Cheshire, has been summonsed to court to face the charge of section 39 assault.
“The 55-year-old is set to appear in magistrates’ court at a later date.
“The charge relates to reports of an assault on a 45-year-old man on Main Street, Frodsham, which was reported to police at 2.48am on Saturday 26 October.”
It was confirmed last month that he has been suspended as a member of the Labour Party.
He now sits as Independent.
