OAKLAND — Two suspects have been charged in a May 11 homicide — one with murder, the other with claiming to have been the victim of an auto theft to cover up the crime, court records show.
Zairy Rubio, 25, was charged Wednesday with murdering 30-year-old Daesjhon Grayson on about 10 minutes before midnight on May 11. The shooting took place on the 600 block of 16th Street in Oakland, near a shelter where Grayson allegedly lived at the time.
A second suspect, Kalif Collins, 24, was charged with being an accessory in the killing. Authorities allege that Collins’ car was used to “transport the shooters” to and from the homicide, and that Collins later filed a fraudulent stolen vehicle report. Collins allegedly claimed his car had been stolen, but a week later informed police he had tracked the vehicle down on his own, court records show.
Collins is no longer in custody. He was arrested on Aug. 11, both for the accessory case and for alleged firearm possession, based on him posing with guns in social media pictures, authorities said. He has been convicted of burglary and retail theft, and isn’t allowed to have a gun, according to the criminal complaint.
Rubio is not listed in the jail’s registry and it is unclear if he’s been taken into custody. Police say he was identified as a suspect based on cellphone records placing him nearby.
After Grayson was killed, police questioned another shelter resident who was seen bleeding from the mouth that night, based on a report that the two had fought. The man refused to provide a statement and wasn’t arrested, court records show.
