Q: There is now a “bell weather” case going forward against some of the pharmaceutical companies trying to hold them liable for the opioid crisis. First, what’s a “bell weather” case, and second, is there any chance the pharmacies will be found liable?

A: When there are a volume of cases against the same parties, the court overseeing the matters has criteria by which a “model case” is tried to give a sense of what may be likely in the remaining actions. This “bell weather” case (sometimes cases) serves to inform the lawyers and the litigants of what the future may bring, which can assist the parties in deciding what to do with the remaining matters.
As to the opioid cases: When there’s an allegation that a medication has caused harm to someone, the claim often brought is for product liability (for example, the medication is inherently dangerous and/or warnings were insufficient). The lawsuit you are referring to is a bit special, brought by two counties in Ohio, arguing the retail pharmacy companies played a substantial role in creating a public nuisance in the way they dispensed pain medication into their communities. The bell weather trial focuses on the harm to the counties. Allegations include that over time there was an overflow of opioid pills dispensed. The burdens this caused the counties are said to be very significant, including on the courts, jails and facilities treating addiction. The pharmacists insist they were simply filling prescriptions written by physicians, and presumably for legitimate reasons.
As to the potential outcome: It is best to “wait and see.” This is a very emotional and controversial set of circumstances.

Q: What does it mean to be the “class representative” in a class action?
A: Class actions are brought on behalf of “all those similarly situated.” There has to be a sufficient commonality of fact and law among the members of the class, and the claims of the “class representative” must be typical of the claims of the class. The class representative is not just a name. He or she should protect the interests of the class; however, my experience is that protection of the class members’ interest tends to be done largely by the lawyer(s) handling the matter.
