Josh Duggar’s Appeal Process: Where He Started and Where He Stands

<p id=”par-1_99″>Beau Brindley insists his client,<a href=”https://www.cheatsheet.com/news/josh-duggar-mentions-narcissists-in-leaked-email-to-anna-duggar.html/”> Josh Duggar</a>, is the target of retaliation by the Bureau of Prisons. He made the unsubstantiated statement after Josh was transferred from FCI Seagoville to <a href=”https://www.cheatsheet.com/news/josh-duggar-moved-to-the-same-federal-prison-that-houses-joe-exotic.html/”>the Federal Medical Center</a> in Fort Worth, Texas, late last month. The famed lawyer insists the BOP began targeting Duggar after his appeals process attempted to highlight an “issue” he and Brindley say exists with the prison mail system. Still, he presses on, attempting to appeal his conviction on possessing and receiving child pornography. Here is where the appeals process stands and the journey since his May 2022 sentencing.</p>

<p id=”par-2_90″>Josh Duggar has spent years trying to oppose his conviction. He’s had multiple lawyers attempt to make a case for him, and he’s even attempted to file his own motions. While most of his appeals have been rejected on merit, his most recent attempt was never even judged on its merits. Josh’s motion was denied by Judge Timothy L. Brooks, the same judge who sentenced the disgraced reality TV star, over a deadline. The appeal didn’t move forward because he did not send out his paperwork ahead of that deadline.</p>

<p id=”par-3_91″>Josh’s window to file closed on June 24, 2025. Under prison mail rules, a document is considered filed on the day an inmate mails it from prison, not the day the court receives it. While the courts didn’t receive his package until weeks after the deadline, he insisted he dropped his motion in a prison mailbox on the deadline day. Prosecutors countered that there was no proof of when he actually mailed it, noting that there was no record of mail from Josh being received on or around the deadline date.</p>

<p id=”par-4_74″>Josh alleged there was no record because he dropped the mail in a regular prison mailbox, not a designated legal mailbox. According to <a href=”https://www.nwahomepage.com/northwest-arkansas-news/federal-judge-denies-josh-duggars-motion-to-vacate-child-porn-conviction/”>KNWA</a>, Judge Brooks did not buy it, claiming that Josh was trying to present<a href=”https://www.cheatsheet.com/news/prosecutors-think-josh-duggar-is-a-liar-he-missed-his-appeal-deadline.html/”> a “magic bullet” theory</a> to the courts. He ruled that the motion was untimely and could not proceed. We will never know if a judge would have considered any of Josh’s eight grounds for a retrial credible.</p>

<h2 class=”wp-block-heading” id=”h-a-long-string-of-failed-appeals”>A long string of failed appeals</h2>

<p id=”par-5_76″>Josh Duggar’s deadline drama is far from his first loss in his pursuit of an appeal. In fact, he’s been served one failure after another since his sentencing. Convicted in December 2021 and sentenced in May 2022 to 151 months in prison, plus 20 years of supervised release, he has now been denied post-conviction relief at every level. Josh has had appeals turned away by the trial court, the 8th Circuit, and the U.S. Supreme Court.</p>

<p id=”par-6_81″>His direct appeal failed in August 2023, when a three-judge 8th Circuit panel upheld the conviction. Duggar had argued that incriminating statements he made to investigators during the search should have been suppressed. The court disagreed, noting that Duggar was not in custody, which made the argument moot. The panel also rejected his bid to point to an alternative perpetrator, a former dealership employee, based solely on that man’s arrest record. The Supreme Court declined to weigh in the following year.</p>

<p id=”par-7_38″>Duggar also attempted to obtain court-appointed representation, claiming he couldn’t afford counsel, before hiring Brindley. As it stands, Josh Duggar has seemingly exhausted almost every angle for early release. He is currently scheduled for release in February 2033.</p>
