Board Certified Family Law Specialist Jenny Bradley gave her exclusive insights.</p>

This move made their eventual split far less complicated when it came to dividing assets. Jenny Bradley, Board Certified Family Law Specialist and the founder of <a href=”https://www.trianglesmartdivorce.com/” target=”_blank” rel=”noreferrer noopener”>Triangle Smart Divorce</a>, an all-woman firm in North Carolina, gave insights to Showbiz Cheat Sheet on the key differences between a postnup and a prenup. And she explained what she believes is the better way to go.</p>
<p id=”par-3_130″>“The key difference is timing: A prenup is signed before the wedding, while a postnup is signed after,” Bradley commented to us. “Both allow couples to set financial ground rules, but there are limits. For example, in most states, including North Carolina, custody can’t be included in either a prenup or postnup, because custody is always decided by a judge based on the best interests of the child. And in North Carolina specifically, a postnup can’t address alimony at all. That’s a major downside, since alimony is often one of the biggest financial sticking points in a divorce. Prenups, by contrast, can include alimony terms if drafted properly, which makes them much more powerful. This varies state by state, though, so it’s important to understand the rules of your state.”</p>
<p id=”par-4_66″>Bradley added that “prenups are almost always the better option” for high-profile couples, like celebrities. “It is much easier to set ground rules at the start than to renegotiate them once the marriage is underway,” she added. “A postnup can still be effective, but the reality is your spouse doesn’t have to sign it, and by then, the dynamics of the relationship can make agreement harder.”</p>

<p id=”par-5_31″>Jenny Bradley noted that both prenups and postnups can protect brand value, image rights, and intellectual property. But it’s generally “easier to get these protections in place before the marriage begins.”</p>
<p id=”par-6_44″>“A postnup can still work, but you have to remember your spouse doesn’t have to sign it once you’re already married,” she continued to Showbiz Cheat Sheet. “That can make negotiations more complicated, especially if the business or brand has already grown in value.”</p>
<p id=”par-7_24″>Postnups can address lifestyle expenses, like travel, security, and staff. But it’s still easier to set the expectations before walking down the aisle. </p>
<p id=”par-8_32″>Either way, both prenups and postnups must be signed “voluntarily, without duress, coercion, or impairment, and ideally after both parties have had the chance to review the terms with their own lawyer.”</p>

<p id=”par-9_30″>Prenups and postnups don’t doom a marriage, Jenny Bradley explained. Instead, these legal documents can help the couple build a “strong foundation” for their future, whether they’re high-profile or not.</p>
<p id=”par-10_30″>Bradley recommends that couples approach a conversation about prenups or postnups with “fairness and transparency rather than fear.” As for celebrities, these documents can also give them the desired privacy.</p>
<p id=”par-11_53″>“Protecting brand, image rights, and intellectual property is much easier when those issues are addressed in a contract rather than litigated in a public courtroom,” she commented. “A well-drafted agreement can keep sensitive financial and personal details out of the headlines, which is critical for anyone whose reputation is tied to their livelihood.”</p>
