A Greenfield man was sentenced to two years in prison Friday after pleading no contest to a felony charge of drunk driving and admitting he violated probation for a prior felony conviction of driving under the influence, prosecutors said.
Fabian Cruz Licona was arrested on May 26 by California Highway Patrol officers who observed him swerving in and out of his lane, according to the Monterey County District Attorney’s Office.
A chemical breath test determined Licona’s blood alcohol content was 0.18%, over twice the legal limit. A records check showed Licona was still on probation for a case of felony DUI with injury from 2023, prosecutors said.
DUI becomes a felony in California when it involves circumstances such as injury, death, prior DUI convictions with 10 years, or a high blood alcohol concentration, according to the website DUI.org.
