MARTINEZ — A Concord woman was sentenced to two years of confinement after pleading no contest to drunk driving in connection with a 2022 crash that killed one pedestrian and injured another, court records show.
Briana Day, 30, pleaded no contest to drunk driving causing injury in the July 30, 2022 crashed that killed 27-year-old Maricarmen Leon. She entered her plea without a deal in place, leaving the final sentence up to Judge Mary Ann O’Malley, according to court records.
Prosecutors say they asked for an eight-year prison term.
Leon was leaving a bar in Walnut Creek at around 2 a.m. when Day crashed a pickup truck into Leon and a second pedestrian before colliding with a cement pillar near North Main and Pine streets, police said at the time.
Leon worked as a phlebotomist at Kaiser Permanente in Walnut Creek and “was an amazing daughter, sister, cousin, and friend,” according to Alexia Larios, who created the page on behalf of her sister Janet Leon.
“She had an amazing spirit with a huge heart, cherishing everyone who entered her life.. constantly smiling and laughing. She was following her dreams at Kaiser as a phlebotomist, where she stood out as a hard worker who always gave her all,” she wrote on the GoFundMe page.
Day remained out of custody on bail while the case was pending, and received credit for one day’s worth of jailtime when she was sentenced, court records show.
